September is National Recovery Month

September is National Recovery Month and we would like to help create awareness and understanding of substance abuse issues in our country, as well as celebrating those in recovery and those who work in prevention and treatment.

According to reports, 20.2 million adults suffer from substance abuse.  Of these, 7.9 million suffer from a co-occurring mental and substance abuse disorder.  Opioid overdoses accounted for more than 42,000 death in 2016, more than any previous year.

There is no standard form of treatment and therefore difficult to measure the success rate of ‘rehab’.  The process of recovery is very personal and differs from person to person, but recovery IS possible.

As an specialized insurance broker, we are honored to work directly with organizations who dedicate themselves in serving those struggling from substance and mental health disorders.  Thank you for allowing us to be a part of your important mission in helping individuals reclaim and transform their lives.

ACTIVE SHOOTER INSURANCE - Hawley & Associates

The US Department of Homeland Security defines an active shooter as someone “actively engaged in killing or attempting to kill people in a confined and populated area”.

Active shooter situations are unpredictable and can happen quickly.  Sadly, the likelihood of an active shooter event is real and Active Shooter Insurance to be a should be a part of your risk management arsenal.

Many GL policies fall short & may leave your organization vulnerable and under-covered in the case of a lawsuit.  Your insurance program should include a comprehensive policy that fills in the gaps where your GL policy leaves off.

Active Shooter Insurance covers:
  • Liability and extra expenses tied to attacks or threats, such as: business income interruption, counseling, public relations and additional/temp security measures
  • Victim death benefits
  • Medical/rehab/funeral and psychiatric expenses
  • Extends to a wide-range of attacks, including: vehicular, explosives and acid attacks
  • Limits available from 1 million to 100 million.
A solid risk management plan along with a comprehensive insurance program can help you respond and recover from the unexpected.

Contact Hawley & Associates for more information.

Extended Reporting Periods - When Does It Apply To Your Nonprofit?

When a nonprofit chooses to close its doors, it may require a special coverage that could add an additional unforeseen insurance cost. This is especially true for the nonprofit that offers specialized professional services like adoption, therapeutic foster care, mental or behavioral health, or skilled medical care. Professional services are insured under a specific type of coverage form called a claims-made p...olicy and it responds differently to a claim then the traditional, better known and understood occurrence policy.

Foster Care Agency Insurance Specialists - Hawley & Associates

As a foster care agency, you are invested in the lives of children who are living with past neglect or abuse. In helping find these children stability by reuniting them with their biological families or finding an loving adoptive family, you are committed to making the world a better place, one child at a time.

There are some important questions to ask yourself concerning the risks, exposures and protection of your agency. Does your broker understand the intricacies of a foster care agency?  Are they able to evaluate and assess your exposure to the risk of sexual abuse?  Is he/she aware that it is also considered sexual abuse if the parent or guardian has failed to adequately protect the child from sexual abuse when the parent or guardian knew or reasonably should have known that the child was in danger?

Hawley & Associates understands these risks and is knowledgeable about the specialty insurance products available to protect your agency, including "Foster Parent Professional" coverage, that protects the foster parents as well.

Contact us today for more information on liability insurance for your organization!

Do You Need Hired & Non-Owned Auto Insurance? The answer may surprise you!

Hired & non-owned auto insurance is a highly misunderstood coverage and often gets put at the bottom of the insurance coverage priority list. Hired and non-owned auto insurance provides coverage for bodily injury and property
damage losses caused by vehicles you don't own, vehicles you lease, hire, rent, and/or borrow, but are used for business operations.  Typically, these vehicles are personally owned by employees and volunteers—in other words, non-owned auto.
Organizations that don’t own company vehicles, may automatically assume they don’t need auto insurance. Nothing could be further from the truth! If you have employees or volunteers that drive their own vehicles on behalf of your organization, for any reason, then you can become responsible for auto claims. Situations where your organization may be responsible for damages can include (but is not limited to):
  • Using their own vehicle to go to meetings
  • Using their own vehicle to go to the bank, the post office, or other errands
  • Using their own vehicle to provide the services offered by your organization

Claims Made vs. Occurrence Forms?

A clear understanding of both types of coverage is crucial in making an informed decision on which type of coverage to buy.  When one coverage is recommended over the other, in certain situations, it is not a matter of what is recommend but what the markets will allow.  For certain types and kinds of coverage a claims-made form is the industry norm.  It could include the following coverage:
  • Directors & Officer Liability
  • Employment Practices Liability Fiduciary Liability
  • Employee Benefits Liability
These are examples of some types of coverage that are predominately written on a claims-made form.  That being said, Professional Liability, Sexual Abuse Liability and to a lesser degree, General Liability coverage may at times be written on a claims made form.

Local Broker vs. Specialty Broker?

Hawley & Associates strongly believes in giving back to the community.  We encourage the support of local businesses and services operating in the areas that we all live and work.  But, when it comes to your insurance broker, you may need to think beyond your hometown borders.

Did you know that having a local broker could actually be a detriment to your organization, not a benefit?  A local broker may not have the necessary knowledge of important state/federal statutes, coverage limitations, a strong relationship with key carriers and access to specialty markets.

Hawley & Associates provides specialized insurance products and services for nonprofits, human service and social service organizations all across the country.  Our expertise gives us a broader view and understanding of the insurance industry and how it affects your organization.  It is our job to stay current on all changes in your industry and to keep your organization and mission protected.

Directors & Officers Liability vs. General Liability

Directors & Officers Liability vs. General Liability

Two critical insurance coverage’s for any nonprofit are General Liability Insurance and Directors & Officers Liability Insurance.  They both provide very different yet critical coverage for your nonprofit.  The key differences are:

Directors & Officers Liability Insurance (often called D&O) provides coverage for “intentional” acts.  This coverage is for defense costs & damages arising out of a wrongful or intentional act allegation and/or lawsuit brought against an organization’s board of directors and/or officers. Nonprofits may not realize that their board members could be held personally liable for the actions of the organization.
Common areas of dispute revolve around discrimination, sexual harassment, wrongful termination, negligence, failure to provide services, intellectual property rights infringement, mismanagement of assets, and misrepresentation of the financial status of the organization, just to name a few.
General Liability Insurance provides coverage for “negligent” acts. “Negligence” is defined as a failure to take proper care in doing something or failure to use reasonable care, resulting in damage or injury to others.  So, if your organization or it’s employees or even your volunteers (including your board members!) are negligent and have caused someone “bodily or personal injury or property damage”, you usually can rely on general liability insurance for coverage.

Many of these claims can be minimized by having good risk management practices & procedures in place.
